Your privacy is important to Kapsch TrafficCom Services USA Inc., a Kapsch Group company.
This statement explains our practices for the Kapsch V2X Assist App (the App).

Who we are

Kapsch TrafficCom USA, Inc. (Kapsch) is a Kapsch Group company, a global organization with legal entities, business processes, management structures, and technical systems that cross borders. Our privacy practices are designed to protect your personal information all over the world. When we do so, we are regulated under the United States and relevant international Privacy Laws, and we are responsible as controller of that personal information for those laws.

Purpose of the V2X Assist App

The Kapsch V2X Assist App connects to your On Board Unit (OBU), a Kapsch device, via Bluetooth and provides you with real time location based traffic messages. The OBU unilaterally manages the logic of the messages transmitted to the App and does not transmit location information to the App. OBU messages to the App are transient in nature and are not retained by the App.

We do not engage other companies and people to perform tasks on our behalf to provide our Services.

Information the App collects

The App requests that you connect to your OBU via Bluetooth. When the App connects to your OBU, the latter handles the logic of the real time traffic data transmitted to the App.

The App acts solely as a display for the OBU. The types of traffic data transmitted to the App are:

  • Vehicle to Vehicle Warnings
  • Vehicle to Infrastructure Warnings

OBU messages transmitted to the App are transient. The data is immediately deleted once it leaves the screen. Data messages cannot be recalled in the App.

Kapsch does NOT receive, collect, process, store, sell, nor share personal or sensitive data through the use of the App. The foregoing includes:

  • Precise or approximate device location,
  • Personally identifiable information,
  • Financial and payment information,
  • Authentication information, device IDs or other unique identifiers,
  • Your phone or contact book data
  • Inventory of other installed apps on your device,
  • Device messages – emails, SMS, MMS
  • Photos, videos, files and documents,
  • App activity, information and performance,
  • Your health and fitness data
  • Web browsing, and
  • Other sensitive device or usage data.

We DO NOT use cookies, web beacon or other technologies that collect information about you and your use of our service, your interactions with us, information regarding your mobile phone, computer, nor any other device used to access the App.

We DO NOT collect non-identifiable information from your download or utilization of the App.

We DO NOT advertise our services on the App.

Children

The App is not targeted to children. You must be 16 years of age or older to subscribe to the App. In certain jurisdictions, the age of the majority may be older or younger than 16; in which case, you must satisfy that age to download or utilize the App.

Your Data Protection Rights

We respond to all requests we receive from individuals wishing to exercise their data protection rights following applicable data protection laws. Without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with the supervisory authority of their jurisdiction, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes their Data Privacy Regulation. We may reject requests that are unreasonable or not required by law, including those that would be extremely impractical, could require disproportionate technical effort, or could expose us to operational risks.

Changes to this Privacy Statement

This Privacy Statement will be updated from time to time in response to changing legal, regulatory, or operational requirements. We will notify any such changes (including when they will take effect) under the law. If you do not wish to acknowledge or accept any updates to this Privacy Statement, you may cancel your use of the App. To see when this Privacy Statement was last updated, please see the “Last Updated” section below.
